Terms of Service

By accessing or using bioflyr ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. We reserve the right to update these Terms at any time; continued use constitutes acceptance.

bioflyr provides a platform that allows users ("Sellers") to create a free online store page hosted at bioflyr.com/store/[slug] and share it as a link-in-bio on social media. Features include:

• Store creation and product management.
• WhatsApp ordering integration.
• PayPal payment links.
• Store analytics (visit counts).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

You must be at least 16 years old to use bioflyr. By registering, you represent that you meet this requirement and that all information you provide is accurate and complete. Businesses may use the Service on behalf of a legal entity, provided an authorised representative accepts these Terms.

• You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
• Notify us immediately at legal@bioflyr.com of any unauthorised access.
• You may not share your account credentials with third parties or create multiple accounts to circumvent restrictions.

You agree not to use bioflyr to:

• Sell illegal goods or services, counterfeit products, or items that infringe intellectual property rights.
• Upload content that is defamatory, obscene, harassing, threatening, or discriminatory.
• Distribute malware, spam, or engage in phishing.
• Scrape, reverse-engineer, or attempt to gain unauthorised access to any part of the Service.
• Use the Service for any purpose that violates applicable laws or regulations.
• Impersonate another person or entity or misrepresent your affiliation with any person or entity.

Violation of this section may result in immediate account suspension or termination without notice.

Your content

You retain ownership of all content you upload (product images, descriptions, store details). By uploading content, you grant bioflyr a non-exclusive, worldwide, royalty-free licence to host, display, and deliver that content solely for the purpose of operating the Service.

Our content

All software, design, trademarks, and other intellectual property on bioflyr belong to us or our licensors. You may not copy, modify, or distribute them without our written permission.

bioflyr is currently free to use. If we introduce paid plans in the future, we will provide at least 30 days' notice and you will not be charged without your explicit consent.

PayPal transactions between Sellers and their customers are governed solely by PayPal's terms. bioflyr does not process, hold, or have access to payment card data.

You may delete your account at any time from your profile settings. We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the violation. Upon termination, your store page will be unpublished and your data deleted within 30 days, subject to legal retention obligations.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOFLYR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless bioflyr and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

These Terms are governed by the laws of Morocco without regard to conflict-of-law principles. Any dispute arising under these Terms shall first be attempted to be resolved amicably by contacting us at legal@bioflyr.com. If unresolved, disputes shall be submitted to the competent courts of Casablanca, Morocco.

We may revise these Terms at any time. For material changes, we will notify registered users by e-mail at least 14 days before the new Terms take effect. The latest version is always available at bioflyr.com/terms.
